Terms of Service

These Terms of Service (“Terms”) govern the design subscription services offered by DWA Design SRL (“Service Provider”, “I”, “my”) through purdeliu.ro. By purchasing a subscription, you (“Client”) agree to these Terms.
1. Services
I provide graphic design, UI/UX design, and web development services on a monthly subscription basis. The specific scope depends on the plan purchased. All plans include unlimited requests in queue, with one or two active requests at a time depending on the plan.
2. Plans & Pricing
Standard: €995/month — up to 25 hours, graphic design only, 1 active request
Pro: €1,750/month — up to 35 hours, graphic design + UI/UX, 2 active requests
Studio: €3,250/month — up to 55 hours, design + development + QA, 2 active requests
Prices are in EUR, exclusive of any applicable taxes. Payment is collected in advance at the start of each billing cycle via Stripe. Work begins only after successful payment confirmation.
3. Monthly Hours & Rollover
Each plan includes a fixed monthly hour pool. At the end of each billing month, 50% of unused hours roll over to the following month, valid for one month only and only while the subscription is active. Hours are forfeited upon cancellation or pause.
If the monthly pool is exhausted before month end, work pauses until the next billing cycle. Additional hours are available as a top-up, invoiced separately.
4. Delivery & Revisions
Graphic design requests are typically delivered within 1–2 business days (simple tasks) or 2–4 business days (complex tasks). UI/UX, development, and QA timelines are estimated per request.
Revisions are unlimited within the original scope of each request. A significant change in direction or new requirements constitutes a new request and draws from the monthly hour pool.
5. Availability & Working Hours
I operate Monday through Friday (excluding Romanian public holidays), Eastern European Time (UTC+2 / UTC+3 during daylight saving). Requests submitted outside working hours are processed the next working day.
For planned absences exceeding 3 consecutive working days, I will notify active clients at least 10 days in advance. The subscription pause policy applies during extended absences if needed.
6. Pause & Cancellation
You may pause your subscription once per calendar year for up to one consecutive month. No billing occurs during a pause. Rolled-over hours are forfeited during a pause.
You may cancel at any time. Cancellation takes effect at the end of the current billing month. No refunds are issued for the current period. Full access is retained until the end of the paid month.
7. Intellectual Property
Upon receipt of full payment for the relevant billing period, all deliverables — including source files and exports — are fully owned by you. I retain no rights to the deliverables after payment.
All deliverables are original creative work. I guarantee they do not infringe third-party intellectual property rights.
I may use completed work for portfolio purposes (purdeliu.ro) unless you request confidentiality in writing.
8. White-Label
White-label service is available for agencies. Work is delivered without purdeliu.ro branding. An NDA is available upon request.
9. Third-Party Costs
Third-party costs — including hosting, domain registration, API credits, software licenses, and developer accounts — are not included in the subscription and are the Client’s sole responsibility.
10. Limitation of Liability
My total liability shall not exceed the total fees paid in the three months preceding the claim. I am not liable for indirect, incidental, or consequential damages.
11. Force Majeure
Neither party is liable for failure to perform due to events beyond reasonable control. The affected party notifies the other within 5 days. If the event persists beyond 30 days, either party may terminate without penalty.
12. Communications
All official communications between parties shall be made via email and are considered received on the next business day after sending. Verbal or phone communications are not binding unless confirmed in writing via email.
13. Dispute Resolution
Disputes shall first be addressed through good-faith negotiation. If no agreement is reached, disputes shall be submitted to the competent courts of Romania.
14. Governing Law
These Terms are governed by Romanian law.
